This Privacy Policy explains how Best Days Labs LLC, a Louisiana limited liability company, collects, uses, stores, shares, and protects information when you visit our websites, register for our resources, use our tools or software, purchase our products, use our portals, or otherwise interact with us.
Best Days Labs LLC operates The Advisors Machine, a website and resource hub serving financial advisors and their firms. Through Best Days Labs LLC and The Advisors Machine, we offer products and services including The Seminar Machine (marketing training), Brand Machine (brand strategy), SeminarIQ (a seminar economics simulation and planning tool), and a free Scorecard diagnostic tool.
"Company," "we," "us," and "our" refer to Best Days Labs LLC. "You" and "your" refer to any visitor, registrant, purchaser, customer, Authorized User, or user of our websites, products, services, communications, portals, or software tools.

0. Three Things to Know Up Front
1. We serve advisors, not their clients — and client information belongs only in the designated Client Data Features of SeminarIQ Pro.
Our products are business-to-business. SeminarIQ Pro includes features expressly designed to accept client-, household-, prospect-, opportunity-, and campaign-level records ("Client Data Features"). Information about your clients that you enter into those features ("Client Data") is handled under strict rules: we use it solely to provide the service, we never use or share it for marketing, and we never give it to our affiliated companies or partners. See Sections 7.2 and 14 and the SeminarIQ Product Addendum, Section 3.
Everywhere else — support tickets, community posts, the Scorecard, the free SeminarIQ tier, and every non-designated field — client information remains strictly prohibited. Certain high-sensitivity data (Social Security numbers, account numbers, health information, and similar) is never permitted anywhere, including in Client Data Features. See Section 14.
2. We are affiliated with other financial services companies, and we have a financial incentive to promote them.
The owners and principals of Best Days Labs LLC hold ownership interests and executive roles in other companies in the financial services industry. This affects how your business information may be used and shared. Please read Section 7 carefully before you provide us with information about your practice.
But there is a hard limit: we never share your clients' information with anyone, ever. See Section 7.1.
3. This is a business relationship, not a confidential one.
Information you provide about your practice — including your assets under management, your production, your Scorecard responses, and the business assumptions you enter into SeminarIQ — is business information you are choosing to share with a commercial counterparty. Do not send us anything you would not want an affiliated company to see.
1. Information We Collect
We collect information directly from you, automatically through your use of our websites, platforms, and software, and from third parties.

1.2 Payment Information
When you purchase a product from us, payment information is collected and processed by our third-party payment processor (such as Stripe).
We do not store full payment card numbers, CVV codes, or full payment card details on our systems. We may receive and retain limited information such as the last four digits, card brand, expiration date, billing name, and billing address.

1.4 Information From Third Parties
We may receive information about you from advertising platforms, analytics providers, webinar platforms, our CRM, data enrichment and firmographic providers, industry databases, publicly available sources (including regulatory filings such as Form ADV and BrokerCheck), and referral partners. We may combine that information with information we collect directly from you.
1.5 What SeminarIQ Collects
SeminarIQ collects:
Account information. Your name, email, firm name, role, and login credentials.
Your business assumptions and inputs. Costs, budgets, expected registration rates, show rates, appointment rates, close rates, revenue per client, venue and mailer costs, scenario names, and similar business planning inputs about your own practice.
Client Data (SeminarIQ Pro only). Records you enter into designated Client Data Features about your clients, households, prospects, opportunities, and campaigns. Client Data is subject to the strict limits in Sections 7.2 and 14 and the Client Data Terms (SeminarIQ Product Addendum, Section 3): service delivery only, never marketing, never shared with Affiliates or Partners.
Usage data. Logins, IP address, session activity, features used, scenarios created, actions taken.
Prohibited Data — Social Security numbers, government identification numbers, account and payment card numbers, banking or third-party login credentials, health or biometric information, and information about minors — must never be entered anywhere in SeminarIQ, including Client Data Features. See Section 14 and the SeminarIQ Product Addendum, Section 3.

To improve and develop our products, tools, software, calculation models, and user experience
To personalize content and advertising
To detect, prevent, or address fraud, misuse, security issues, unauthorized account sharing, unauthorized use of our tools, or technical problems
To enforce our Terms & Conditions and protect our intellectual property, including by using access logs, IP addresses, session data, and usage telemetry as evidence
To comply with applicable legal obligations and respond to legal process
2.1 Aggregated, De-Identified, and Derived Data
We may aggregate, anonymize, or de-identify information — including Scorecard responses, SeminarIQ scenario inputs and assumptions, survey responses, usage data, and business performance data — and use the result for any lawful business purpose, without restriction and indefinitely.
This includes:
Developing, training, testing, and improving our products, tools, calculation models, algorithms, scoring models, optimization logic, and artificial intelligence and machine learning features
Producing and publishing industry benchmarks, research, reports, and marketing content
Creating and licensing datasets and analytics products
Aggregated and de-identified data does not identify you or your firm and is not treated as personal information under this Privacy Policy.
We do not sell or provide your identifiable personal information to any third party for the purpose of training that third party's general-purpose artificial intelligence models. We may use AI tools and vendors under contract as service providers to help us operate, analyze, and support our business.
2.2 THE ABSOLUTE LIMIT: Client Data Is Never Used for Marketing
Section 2.1's aggregation and de-identification rights apply to business information about you and your firm, and to Client Data only as stated in this Section 2.2.
We never use any client's nonpublic personal information for marketing, advertising, recruiting, audience-building, or business development, and we never share it with any Affiliate, Partner, or other third party for any commercial purpose, ever.
With respect to Client Data entered into designated Client Data Features: we use it solely to provide, secure, maintain, and support the services, and we may derive aggregated, de-identified statistics — such as community benchmarks — in which no client, household, or consumer is identifiable (Section 7.2). That is the entire list.
Client information provided outside Client Data Features, in breach of our Terms, may be deleted at any time without notice; we disclaim any right to use it and any duty with respect to it.
3. Email, Phone, SMS, and Automated Communications
3.1 Email
By providing your email address, you agree that we may send you emails about Scorecard results, SeminarIQ access and results, webinar registrations, product information, training resources, account and access information, customer support, and marketing communications.
3.2 Calls and Text Messages
We obtain your express written consent to marketing calls and texts at the point where you give us your phone number, not through this Privacy Policy. Where a form asks for your phone number and includes a consent disclosure and checkbox, checking that box means:
You agree that Best Days Labs LLC, its Affiliates, and the marketing partners identified in the consent disclosure presented to you, and their agents, may contact you at the phone number you provide, including by automatic telephone dialing system, artificial or prerecorded voice, ringless voicemail, and SMS or MMS text message, for marketing, webinar reminders, product information, training resources, and customer support.
Where we intend for your consent to cover an Affiliate or Partner, the consent disclosure presented at the point of collection will identify that company or the categories of companies covered. A Partner with whom we share your phone number but who is not covered by your consent is responsible for obtaining its own consent before placing calls or texts that require it.
Consent to receive marketing calls or text messages is not required as a condition of any purchase. Message and data rates may apply. Message frequency varies.
3.3 How to Opt Out
Email: Click the unsubscribe link in any marketing email, or email info@bestdayslabs.com.
Text: Reply STOP to any text message. You may also reply QUIT, END, CANCEL, UNSUBSCRIBE, or OPT OUT. Reply HELP for help.
Calls: Tell the caller you wish to be placed on our internal do-not-call list, or email info@bestdayslabs.com.
Any method: You may revoke consent by any reasonable means, including by replying to a message, emailing us, or calling 877-235-7429. We do not require you to use a specific word or method.
We will honor a revocation request within the time required by applicable law. A revocation of consent to marketing texts or calls applies across all of our marketing campaigns, not just the campaign you replied to. We maintain an internal do-not-call list.
3.4 Transactional Messages
Even if you opt out of marketing, we may still send you messages necessary to deliver a product you purchased or to administer your account, including account, access, billing, security, software service, and support messages.
3.5 Recording and Monitoring
Calls, webinars, coaching sessions, and support interactions may be recorded and monitored for quality, training, product development, and marketing purposes. See Terms Section 14.
Do not share your screen while displaying client information.
4. Cookies and Tracking Technologies
We use cookies, pixels, tags, SDKs, session and analytics tools, and similar technologies to operate our websites, remember preferences, analyze traffic, measure campaign performance, personalize content, and support advertising and retargeting.
These include, but are not limited to, technologies provided by:
Website and landing page hosting providers
Analytics providers (for example, Google Analytics)
Advertising platforms (for example, Meta, Google, LinkedIn)
CRM and marketing automation platforms (for example, GoHighLevel)
Webinar and course platforms
Scorecard and diagnostic tool providers
Chat, support, and session replay tools, which may record your interactions with our websites, including pages viewed, clicks, scrolling, form entries, and chat messages. By using our websites, you consent to this recording and monitoring of your interactions, including by the third-party providers of these tools.
4.1 Inside the SeminarIQ Application
Within the authenticated SeminarIQ application, we use only the cookies necessary to operate the service — session management, authentication, and security.
We do not run third-party advertising pixels, advertising cookies, or session-replay tools inside the authenticated SeminarIQ application. We treat this as a security requirement, not a preference.
Your choices:
You may disable cookies through your browser settings. Disabling cookies may affect how our websites function and may prevent SeminarIQ from working at all.
Where we display a cookie consent banner or preference center, you may manage your choices there.
We do not currently respond to Global Privacy Control or other browser-based opt-out preference signals, except where required by applicable law.
5. Service Providers and Third-Party Platforms
We share information with third-party service providers that help us operate our business, websites, products, and software. These may include:

Service providers process information under their own terms and privacy policies. Some act on our behalf; others act as independent controllers of your information. We are not responsible for the privacy or security practices of any third-party platform. See Terms Section 19.
Client Data is disclosed only to the infrastructure providers necessary to host and operate SeminarIQ (currently including Supabase, Vercel, and Resend), and never to advertising, analytics, CRM, or marketing platforms. See the Client Data Terms (SeminarIQ Product Addendum, Section 3).
6. Advertising and Retargeting
We use online advertising platforms to promote our products and services. These platforms may use cookies, pixels, hashed identifiers (such as a hashed version of your email address), and similar technologies to help us measure advertising effectiveness, create custom and lookalike audiences, and deliver relevant advertisements.
We do not sell your personal information for money. However, some privacy laws define certain advertising, retargeting, analytics, and audience-sharing activities as a "sale," "sharing," or "targeted advertising."
To the extent our activities constitute a "sale," "sharing," or "targeted advertising" under a law that applies to us, you may opt out by emailing info@bestdayslabs.com, using our cookie preference center if available, or enabling Global Privacy Control in a supported browser.
We do not use, and will not use, any client information in any advertising, retargeting, audience-building, or lookalike activity, ever.
7. Affiliated Companies, Conflicts of Interest, and How We Use Your Business Information
Read this section before you give us information about your practice.
The owners, officers, and principals of Best Days Labs LLC hold ownership interests, executive positions, board seats, or other roles in other companies in the financial services industry, which may include an SEC-registered investment adviser, a wealth management platform and independent marketing organization serving independent advisors, and a private wealth management firm (each, an "Affiliate"). These are separate legal entities from Best Days Labs LLC.
Assume the following:
Information you provide to us — including your name, firm, contact information, assets under management, production, revenue, Scorecard responses, and the business assumptions and scenario inputs you enter into SeminarIQ — may be used by Best Days Labs LLC to market our own products and services to you.
We may share your information with our Affiliates, who may use it to market their products, services, platforms, technology, and affiliation opportunities to you, including recruiting and business development outreach.
Our principals benefit economically from the growth of our Affiliates and have a financial incentive to promote them to you. Any recommendation, introduction, or favorable statement we make about an Affiliate is not independent or objective.
Our content is not neutral research. Commentary we provide about platforms, custodians, broker-dealers, RIAs, IMOs, technology vendors, or business models may be influenced by our affiliations.
Business partners. The term "Affiliate" includes entities now existing and entities later formed, acquired, or invested in by our owners or principals. In addition, we may establish co-marketing, referral, sponsorship, or other business relationships with unaffiliated companies ("Partners") at any time. Where permitted by applicable law, we may share the following with Partners for their marketing purposes, and this Section, including the opt-out below, applies to Partner sharing the same way it applies to Affiliate sharing:
Business Contact and Profile Information, meaning your name, business email address, business phone number, business mailing address, firm name and firm type, role or title, and website URL
General business activity information, meaning information about your use of our products at a business level — for example, which products you use, your engagement level, and summary usage such as the number of seminars or campaigns you have modeled or planned — but not the contents of your scenarios, your specific financial inputs and assumptions, or your Scorecard responses, which we share only with Affiliates under this Section or in aggregated, de-identified form under Section 2.1

What we never share with Partners: payment card or banking information, login credentials, government identification numbers, the identifiable contents of your SeminarIQ scenarios or Scorecard responses, and — as always and with anyone — any client information (Section 7.1).
Your right to opt out. You may opt out of the sharing of your information with our Affiliates or Partners for their marketing purposes at any time by emailing info@bestdayslabs.com with the subject line "Affiliate Opt-Out." Opting out will not affect your access to our products, including SeminarIQ.
No obligation. Our training products and tools are not an offer, inducement, or solicitation to affiliate with, transfer business to, or join any Affiliate. Your purchase, access, pricing, support, and SeminarIQ access are not conditioned on doing business with any Affiliate.
Your obligations to your current firm are yours. If you are subject to a non-solicitation, non-compete, confidentiality, garden leave, or similar agreement with your current broker-dealer, RIA, IMO, or carrier, you are solely responsible for complying with it. Do not provide us with information you are not permitted to share. We do not ask you to breach any agreement, we do not advise you on whether any disclosure or action would breach an agreement, and you should not treat our forms, our tools, our content, or any conversation with us or an Affiliate as an invitation to do so.
7.1 THE HARD WALL: Affiliate Sharing Never Touches Client Information
This is an absolute limit. It has no exceptions and is not subject to any other provision of this Privacy Policy.
Affiliate sharing under Section 7 covers your own business information — you, your firm, your practice — and nothing else.
We do not share, and we will never share, with any Affiliate, Partner, or other third party, any nonpublic personal information about any of your clients, prospects, or any consumer, for marketing, recruiting, business development, or any other commercial purpose, ever.
No Affiliate or Partner has, or will be given, access to it.
Client Data entered into designated Client Data Features is disclosed only to the infrastructure service providers who host and operate our systems, as required by valid legal process, or at your direction (Section 7.2; SeminarIQ Product Addendum, Section 3).
Outside those designated features, you are prohibited from giving us client information at all (Section 14, Terms Section 21).
No provision of this Privacy Policy, our Terms, or any other document grants us or any Affiliate or Partner any right to use, share, or monetize it for any commercial purpose.
To state it as plainly as we can: your client list is not part of this deal, and never will be.
7.2 Client Data in SeminarIQ Pro
SeminarIQ Pro includes designated Client Data Features that accept client-, household-, prospect-, opportunity-, and campaign-level records ("Client Data"). The following commitments apply to Client Data:
Never shared for marketing. We do not share Client Data with any Affiliate, Partner, or other third party for marketing, recruiting, or business development purposes, ever.
Service delivery only. We use Client Data solely to provide, secure, maintain, and support the services. It is disclosed only to the infrastructure service providers who host and operate our systems (Section 5), as required by valid legal process, or at your direction.
Advisor-level information remains advisor information. Information about you and your practice at the advisor or firm level — for example, your production, sales volume, campaign activity, and business performance — is your business information and may be used and shared as described in this Section 7, even where it is derived from your use of a Client Data Feature. (Example: the fact that your firm placed a given volume of business in a year is advisor-level information; the identity, holdings, or finances of any client or household are not.)
Aggregated benchmarks. We may derive, use, and publish aggregated, de-identified statistics as described in Section 2.1, including community benchmarks, provided no client, household, or consumer is identifiable.
The full Client Data Terms — including our security commitments, breach notification to your firm, and deletion rights — are in Section 3 of the SeminarIQ Product Addendum.
8. Scorecard, SeminarIQ, and Diagnostic Tools
The Scorecard collects business information you submit about your practice and generates feedback based on it. SeminarIQ collects business assumptions you enter about your practice and calculates projections from them.
We use Scorecard responses and SeminarIQ inputs to:
Generate and deliver your results
Follow up with you about your results by email, phone, and text
Recommend and market our products and services
Market the products, services, platforms, and affiliation opportunities of our Affiliates, unless you opt out under Section 7
Analyze aggregate and de-identified trends across users to improve our products, develop new products, calculation models, and AI features, and publish industry benchmarks and research (see Section 2.1)
We may retain your Scorecard responses and SeminarIQ inputs indefinitely. If you would like them deleted, email info@bestdayslabs.com and we will honor the request to the extent required by applicable law and consistent with our legitimate business and legal-hold needs.
Scorecard and SeminarIQ outputs are educational and informational only, are generated by an automated system, and are not a valuation, audit, benchmark against a verified peer set, compliance review, or prediction of your future performance.
SeminarIQ outputs are hypothetical projections and are for your internal use only. Do not present them to any prospect, client, or member of the public. See the Results Disclaimer and the SeminarIQ Product Addendum, Section 4.
9. How We Share Information
We may share information:
With service providers who help us operate our business
With payment processors to process transactions
With webinar, portal, course, community, Scorecard, hosting, and database platforms to deliver products and tools
With advertising and analytics providers
With our Affiliates and Partners, as described in Section 7 — business information only, never client information (Section 7.1)
With professional advisors, such as attorneys, accountants, and consultants
In connection with any actual or contemplated business transaction, such as a merger, sale, financing, acquisition, reorganization, bankruptcy, or transfer of assets, including in due diligence, and your information may be transferred as a business asset
When required by law, subpoena, court order, legal process, regulator request, or government request
To protect our rights, property, users, business, or others, and to investigate fraud, security incidents, or violations of our Terms
To enforce our agreements and policies
With your consent or at your direction
We do not sell your personal information for money.
10. Data Retention — We Are Not Your Recordkeeper
Read this if you are relying on us to keep anything.
We commit to no retention period whatsoever. We retain information for as long as we determine is reasonably necessary in our sole discretion, and we may retain it indefinitely, or delete it at any time.
We are not a books-and-records system, an archive, a recordkeeping system, or a system of record for any purpose, including Advisers Act Rule 204-2, FINRA Rule 4511, or any state or firm retention requirement. No product or tool we operate — including SeminarIQ — is any of those things.
We have no obligation to retain, preserve, archive, back up, export, produce, restore, or account for any information, content, scenario, projection, campaign record, or account data, for any period.
We may delete, purge, or lose any of it at any time, for any reason or no reason, with or without notice, and without liability to you.
We are not obligated to respond to any request from you, your firm, your supervising entity, or any regulator to produce, preserve, or restore data, except where compelled by valid legal process served on us.
You are solely responsible for your own books, records, and retention obligations. If you need a record, export it and keep it yourself. If you do not and it is lost, that is your loss and not ours.
We are not obligated to delete information except where deletion is required by a law that applies to us, and we may retain information notwithstanding a deletion request where retention is permitted or required, including to:
Evidence your consent and honor your opt-out and suppression preferences
Comply with tax, accounting, and legal obligations
Detect and prevent fraud and enforce our Terms
Defend against or pursue legal claims, including under any legal hold
Maintain aggregated or de-identified data, which we may retain and use indefinitely (see Section 2.1)
Client Data is different in one respect: while your SeminarIQ Pro subscription is active, we will not intentionally delete your Client Data except as the Client Data Terms permit (Prohibited Data, legal requirements, or your direction) — though we still provide no backup, recovery, or archival warranty, and we remain not your books-and-records system. After termination, we may delete Client Data at any time in the ordinary course, and we will honor a verified written deletion request as described in the Client Data Terms. Export what you need before termination. See the SeminarIQ Product Addendum, Section 3.

11. Data Security
We use administrative, technical, and organizational measures that we consider reasonable and appropriate for a business of our size and type, designed to protect information. For SeminarIQ, these include authentication, role-based access controls, database-level tenant isolation, and encryption in transit and at rest.
However, no website, platform, database, vendor, or internet transmission is completely secure. We do not guarantee, warrant, or represent that information will be secure, and we expressly disclaim any such warranty.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us at security@bestdayslabs.com if you believe your account has been compromised.
If we experience a security incident affecting your personal information, we will provide notice to the extent required by applicable law. For a breach of Client Data, we will notify your firm as described in the Client Data Terms (SeminarIQ Product Addendum, Section 3) — without unreasonable delay and no later than 72 hours after determining that unauthorized access to unencrypted Client Data has occurred. Our services depend on third-party infrastructure providers, and our responsibility for security incidents — including incidents originating with a third-party provider — is allocated and limited as described in Terms Sections 22.1 and 23.
Outside designated Client Data Features, our systems are not designed to hold, and should never hold, any consumer's nonpublic personal information (Section 14). If you enter client information in breach of our Terms — outside a Client Data Feature, or as Prohibited Data anywhere — we assume no duty, obligation, or status with respect to it, and you bear all resulting responsibility. See Section 14 and Terms Section 21.
12. Your Privacy Rights
Depending on where you live and whether a given law applies to us, you may have the right to:
Know / Access. Request access to, or a copy of, the personal information we maintain about you, and information about how we use and share it
Correct. Request correction of inaccurate personal information
Delete. Request deletion of your personal information
Portability. Request a copy in a portable format
Opt out of targeted advertising, "sale," or "sharing"
Opt out of profiling that produces legal or similarly significant effects
Limit use of sensitive personal information, where applicable
Opt out of marketing communications at any time
Opt out of Affiliate sharing (see Section 7)
Non-discrimination. We will not deny you products, charge you a different price, or provide a different level of service because you exercised a privacy right that applies to you
How to make a request: Email info@bestdayslabs.com or write to us at the address in Section 18. Include your name, the email address associated with your account, and what you are requesting.
Scope. We will honor requests to the extent required by an applicable privacy law. Where a law does not apply to us, or where an exception, exemption, or legal-hold obligation applies, we may decline a request, in whole or in part, in our discretion. Marketing opt-out requests are always honored.
Verification. We may require you to verify your identity before processing a request, and may decline a request we cannot verify.
Authorized agents. You may use an authorized agent to submit a request. We may require proof of authorization and may require you to verify your own identity directly.
Timing. We will respond within the time required by applicable law.
Appeals. Where an applicable law provides an appeal right and we deny your request, you may appeal by emailing info@bestdayslabs.com with the subject line "Privacy Appeal." If your appeal is denied, you may contact your state Attorney General.
Requests from your clients. If you are a client of an advisory firm: any information we hold about you was entered by your advisor's firm, and we process it solely as a service provider to that firm. Please direct your request to your advisor's firm — it is the party responsible for your information, and we act on its instructions. We will refer any request we receive to the firm and assist it as the Client Data Terms provide.
13. State-Specific Privacy Rights
A note on scope. Comprehensive state privacy laws (including in California, Virginia, Colorado, Connecticut, Utah, Texas, and other states) generally apply only to businesses that meet revenue or data-volume thresholds, and several of them exclude or limit rights with respect to information collected in a business-to-business or employment context.
Our products are business-to-business, and much of the information we collect is business contact and business performance information collected in a commercial context.
Whether, and to what extent, any state privacy law applies to Best Days Labs LLC depends on our size, revenue, processing volume, and the nature of the information at issue. Nothing in this Privacy Policy is an admission that any particular law applies to us.
California. To the extent the California Consumer Privacy Act, as amended, applies to us, California residents may have rights to know, delete, correct, opt out of sale or sharing, limit the use of sensitive personal information, and be free from discrimination for exercising those rights. We do not sell personal information for money. Certain advertising and analytics activities may constitute "sharing" or "cross-context behavioral advertising." Other states. Residents of other states with comprehensive privacy laws may have similar rights to the extent those laws apply to us. Contact info@bestdayslabs.com.
14. Client Information: Designated Features Only
This section is a material term. Read it.
Client Data is permitted only in the designated Client Data Features of SeminarIQ Pro (Section 7.2; SeminarIQ Product Addendum, Section 3). Everywhere else, client information is strictly prohibited.
14.1 Where Client Information Is Prohibited
Do not send us client information, and do not enter it, anywhere outside a designated Client Data Feature:
In support tickets, emails, chats, or phone calls
In community posts or comments
In Scorecard responses
On coaching calls, webinars, or screen shares
In shared documents, spreadsheets, or files
In SeminarIQ base (free tier), which contains no Client Data Features
In any SeminarIQ field that is not part of a designated Client Data Feature — including any free-text, notes, description, label, scenario-name, or comment field in the simulation and planning features
Redact before you send.
14.2 Prohibited Data — Never, Anywhere
The following must never be entered into any tool we operate, including Client Data Features: Social Security numbers and tax identification numbers; driver's license, passport, and other government identification numbers; financial account numbers, payment card numbers, and banking credentials; login credentials of any third party or client; health, medical, or biometric information; and information about individuals under 18. Client Data Features do not require this information and our systems are not designed to hold it. We may delete it at any time without notice.
14.3 Consequences
Entering Prohibited Data anywhere, or providing client information outside a designated Client Data Feature, is a breach of our Terms & Conditions.
If you do so:
You do so entirely at your own risk.
You remain solely responsible for any obligation, cost, liability, fine, penalty, examination, or claim arising under Regulation S-P, the Gramm-Leach-Bliley Act, state privacy or data-security law, your firm's policies, or any other law or rule.
You agree to indemnify us for any resulting claim. See Terms Section 25.
We may delete it at any time, without notice, with no obligation to preserve, return, secure, safeguard, encrypt, restrict access to, or account for it.
We may suspend or terminate your access, without refund.
You cannot create a legal obligation on our part by breaching our Terms. Client Data lawfully entered into Client Data Features is governed by the Client Data Terms; information provided in breach of this Section is not.
14.4 No Waiver
Our failure to detect, prevent, remove, or object to any information provided in violation of this Section does not constitute consent, acceptance, waiver, or modification of this Section, and creates no duty on our part with respect to that information.
15. Children's Privacy
Our websites, products, and tools are intended for business professionals who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we learn we have collected personal information from a person under 18, we will take reasonable steps to delete it.
16. International Users and Third-Party Links
Our business is based in the United States and our products are intended for the United States market. We do not target, market to, or knowingly offer our products to individuals in the European Economic Area, the United Kingdom, or other jurisdictions with extraterritorial privacy regimes.
If you access our websites, tools, or purchase our products from outside the United States, you do so on your own initiative, and you understand that your information will be transferred to, stored in, and processed in the United States, where privacy laws differ from those in your country.
Our websites, emails, and portals may contain links to third-party websites, platforms, or services. We are not responsible for the privacy practices, content, or policies of third parties.
17. Changes to This Privacy Policy
We may update this Privacy Policy at any time, in our sole discretion. The updated version will be posted with a revised "Last Updated" date and takes effect when posted.
Material changes to how we use previously collected personal information will apply to that information only as permitted by applicable law; where a law that applies to us requires consent for such a change, we will obtain it.
We are not required to provide notice of changes by email, mail, or any individual delivery method. We may provide notice by posting on our websites, in your portal, or in the application, or by presenting the updated Privacy Policy through a click-through acceptance mechanism when you next log in. Where you accept through a click-through, the update is effective immediately upon your acceptance, and our records of that acceptance, including date, time, IP address, and version presented, shall be conclusive evidence of your acceptance absent manifest error.
It is your responsibility to review this Privacy Policy periodically. Your continued use of our websites, tools, or products after an update is posted means you accept the revised Privacy Policy.
